01Acceptance of terms
By creating a Fair Cash account or by using the App, you confirm that you have read, understood, and agreed to these Terms, along with our Privacy Policy and any product-specific disclosures shown to you in-app at the point of application.
These Terms constitute a legally binding agreement between you and Neo Microfinance Institution S.C., a share company licensed and supervised by the National Bank of Ethiopia as Microfinance Institution No. 41 under Proclamation No. 626/2009 as amended by Proclamation No. 1164/2019.
02Eligibility
To use Fair Cash, you must:
- Be a resident of the Federal Democratic Republic of Ethiopia
- Be at least 18 years of age
- Hold a valid Fayda National ID
- Have an active Ethiopian mobile phone number registered in your own name
- Maintain a Telebirr wallet or a registered account with a licensed Ethiopian bank for disbursement and repayment
- Have full legal capacity to enter into binding contracts under Ethiopian law
- Use a mobile device that meets the App's minimum technical requirements (disclosed on the App Store and Google Play listings)
Neo MFI reserves the right to impose additional eligibility criteria at its discretion and to refuse service where eligibility cannot be verified. Fair Cash is not available to persons who are subject to applicable sanctions, are on any national or international sanctions list, or whose use of the App would violate Ethiopian law.
03The Fair Cash service
Fair Cash is an unsecured short-term digital microloan product, designed for delivery entirely through the mobile App. Key characteristics:
- Loan range: ETB 1,000 to ETB 50,000 (actual offer determined at point of application)
- Tenure: 14 to 90 days
- Disbursement: to your Telebirr wallet or registered Ethiopian bank account
- Repayment: via Telebirr or bank partner rails, on schedule disclosed in-app
- Pricing: service fees, interest, and any applicable late-payment charges are disclosed to you in-app before you accept the loan offer
Service features, eligibility criteria, loan limits, fees, and repayment terms are finalised and disclosed at the point of application. Neo MFI may introduce, modify, or withdraw the service at its discretion, subject to the supervisory framework of the National Bank of Ethiopia.
Neo MFI also operates other credit products (Green Finance for electric vehicles and Business Finance for registered enterprises) under its MFI licence. Those products are separate from Fair Cash and are accessed through different channels — see neo.et ↗ for information.
04App licence & intellectual property
Neo MFI grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download, install, and use the Fair Cash App on mobile devices you own or control, solely for accessing Neo MFI's credit services for your personal, non-commercial use. All other rights are reserved.
You must not:
- Copy, modify, distribute, sell, lease, rent, sublicense, or create derivative works of the App or any part of it
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
- Use automated tools (bots, scrapers, scripts) to interact with the App except where expressly permitted
- Circumvent any security, rate-limiting, or fraud-detection mechanisms
- Use the App in any manner that could damage, disable, overburden, or impair Neo MFI's systems
- Remove, obscure, or alter any proprietary notices, trademarks, or branding in the App
Intellectual property
The Fair Cash App, the Neo MFI and Fair Cash brand marks, the staircase logomark, the colour system, the content displayed in the App, and all underlying software, algorithms, and designs are the exclusive property of Neo Microfinance Institution S.C. or its licensors, protected by Ethiopian copyright, trademark, and other intellectual-property laws. Nothing in these Terms transfers ownership of any intellectual property to you.
App store distribution terms: your download and use of the App via the Apple App Store or Google Play Store is also governed by the applicable end-user licence agreement of that platform. Where there is a conflict between these Terms and the platform's terms, the platform terms govern the download and installation mechanics only; Neo MFI's Terms govern the service itself.
05Account registration & security
When you register for a Fair Cash account, you must:
- Provide accurate, current, and complete information during registration and throughout your use of the App
- Promptly update your information if it changes (for example, a new phone number or address)
- Maintain the confidentiality of your account credentials — passwords, PINs, biometric secrets, and one-time verification codes
- Not share your credentials with any third party, including family members, friends, or agents
- Notify Neo MFI immediately at info@neo.et or +251 115 586 969 of any unauthorised access to, or use of, your account
- Use only your own device and credentials — one Fair Cash account per person
You are responsible for all activity that occurs under your account. Neo MFI is not liable for losses arising from your failure to maintain the confidentiality of your credentials.
Neo MFI reserves the right to decline applications, suspend accounts, or terminate services where inaccurate information, suspicious activity, or breach of these Terms is identified.
06Loan applications
When applying for credit through Fair Cash, you acknowledge that:
- Every application is subject to a credit and affordability assessment
- Approval is not guaranteed and is at Neo MFI's sole discretion
- All fees, interest, repayment dates, and any applicable penalties are disclosed to you in-app before you accept the loan offer
- Acceptance of a loan offer is made electronically through the App and creates a legally binding obligation equivalent to a signed written contract under Ethiopian law
- Loan limits and terms are determined by Neo MFI's credit engine based on your profile, stated information, and repayment history
- Providing false, misleading, or incomplete information during application may result in rejection, account closure, and referral to law enforcement in cases of fraud
07Loan agreements & repayment
Each accepted loan offer creates a separate, legally binding loan agreement between you and Neo MFI, governed by the specific disclosure you accepted in-app (principal, fees, interest, tenure, repayment schedule) together with these Terms.
You are responsible for:
- Repayment on or before each scheduled due date
- Maintaining sufficient funds in your Telebirr wallet or bank account to cover scheduled repayments
- Reviewing all loan disclosures carefully before accepting an offer
- Contacting customer support promptly if you anticipate difficulty meeting a payment
Repayments may be made through the channels disclosed in-app, including Telebirr and partner bank rails. Prepayment, restructuring, or rescheduling options (if available for your loan product and circumstances) will be disclosed in-app or through customer support.
08Late payment & default
Failure to meet repayment obligations may result in:
- Late-payment charges as disclosed in your loan agreement
- Reduced or withdrawn access to future Fair Cash credit offers
- Reporting to licensed credit reference bureaus in accordance with Ethiopian regulations — which may affect your ability to borrow from other lenders
- Recovery action through lawful channels, which may include the involvement of authorised recovery agents or legal process
All Neo MFI recovery practice operates strictly within the framework set by the National Bank of Ethiopia and applicable Ethiopian law. Borrowers experiencing a material change in circumstances are strongly encouraged to contact customer support before their due date — early communication generally produces better outcomes for everyone.
09Your responsibilities
By using Fair Cash, you agree to:
- Provide accurate and complete information at all times
- Use the App only for lawful purposes and for the defined financial purpose you disclose during application
- Not attempt to circumvent credit-assessment, fraud-prevention, or identity-verification systems
- Not use the App to facilitate money laundering, terrorism financing, tax evasion, or any activity prohibited under Ethiopian law
- Not use the App on behalf of another person or allow another person to use your account
- Comply with all applicable laws and regulations when using the App
- Keep your contact details up to date so we can reach you about your account
10Limitation of liability
To the maximum extent permitted by Ethiopian law, Neo MFI's liability to you is limited as follows:
- The App is provided “as available”; we do not guarantee uninterrupted or error-free operation, and we are not liable for temporary service outages caused by technical issues, network problems, or maintenance
- We are not liable for losses caused by your failure to keep credentials confidential or by your negligent use of the App
- We are not liable for losses caused by third-party services beyond our reasonable control, including Telebirr, bank rails, Ethio Telecom, or the Apple App Store and Google Play Store
- We are not liable for consequential, indirect, special, or punitive damages
Nothing in these Terms limits any liability that cannot be limited under Ethiopian law, including liability for fraud or gross negligence.
11Service updates
Neo MFI may update the App, service features, operational processes, fee schedules, or these Terms from time to time, as required by regulatory, technical, or operational considerations. Updated versions will be published on our official platforms (the App and faircash.et) and, where material, communicated to active users through in-app notification or email.
Continued use of the App following any update constitutes acceptance of the revised Terms. If you do not accept an update, you must discontinue use of the App and may request account closure and loan settlement in accordance with your loan agreement.
12Governing law & dispute resolution
These Terms are governed by the laws of the Federal Democratic Republic of Ethiopia. Any disputes arising from or relating to these Terms, your use of the App, or your loan agreements with Neo MFI shall be resolved under Ethiopian law and are subject to the jurisdiction of the competent courts of Ethiopia.
Before initiating formal proceedings, we encourage you to contact Neo MFI customer support to resolve the matter directly. Complaints not resolved through our internal process may be escalated to the National Bank of Ethiopia's consumer-protection framework in accordance with applicable regulations.
